General Information Onsite regulations for Massachusetts were last updated on November 3, 1995. There have been a few minor corrections and clarifications. However, there is not a definite date for promulgation. There are currently no plans to update or revise the current regulations. A portion of the current regulations are written on a performance based standard. Massachusetts considers an innovative technology as a technology that will provide equal or greater environmental protection than a Title 5 system. An experimental technology is considered one that is approved for piloting or provisional use. Massachusetts has an innovative and alternative (I/A) program designed and contained within Title 5 to cover the use of I/A technologies. The state of Massachusetts does not require management systems or management districts to monitor and maintain onsite systems. Three funding mechanisms are available to assist homeowners with replacement of failing systems or installation of new systems. Two options are available through loans provided by communities with state appropriated funds. The communities administer the money to the individual homeowners and the loans are paid back to the communities through individual recipient taxes. The third funding source is FHA Title I loans. These loans are available through local banking institutions at a low interest rate.
