Individual and Small On-Site Wastewater Systems
Chapter 74:53:01
April 30, 1997

Onsite regulations for South Dakota were last amended in April 1997. There are no plans to update the current regulations prior to July 31, 2002.

Those technologies approved for onsite wastewater treatment and disposal include:
1. A conventional system consisting of a septic tank with a soil absorption system;
2. An aerobic treatment unit utilizing a sedimentation process in conjunction with a soil absorption system;
3. A septic tank with an evapotranspiration, an evapotranspiration-absorption, or a mound system;
4. A holding tank;
5. A septic tank with a graywater system; or
6. Stabilization ponds, if plans and specifications are prepared, submitted, and approved in accordance with chapter 74:53:03.
Unconventional systems may be allowed when water or electrical systems are unavailable, i.e., vault privies, chemical toilets, incinerator toilets, or composting units. With the exception of vault privies, all unconventional systems are considered experimental systems, and plans and specifications shall be submitted for approval as an experimental system prior to installation. Surface discharge is an option for onsite septic disposal systems in South Dakota if they meet the conditions set forth in a NPDES permit from the South Dakota Department of Environment and Natural Resources.

Drainfield area/size reduction is allowed by the State Code, depending on the technology. The required bottom area may be reduced by the following percentages for trenches only: 20% for 12 inches or more but less than 18 inches of fill material below the distribution pipe; 34% for 18 inches or more but less than 24 inches of fill material below the distribution pipe; and 40% for 24 inches or more of fill material below the distribution pipe. Several of the manufactured drainfield systems are allowed 20% reductions in drainfield size. Technologies considered for drainfield reductions are reviewed by the Department's Staff Engineer who determines whether the technology is acceptable, if any reduction in sizing will be allowed, and the percent of reduction allowed.

No funding program exists to assist homeowners either replacing a failing system or installing a new one, and there are no plans to develop such a mechanism.

Currently, there are no ongoing onsite wastewater demonstration, research, or testing projects in the state.

South Dakota Code does not recognize or require management programs/contracts or districts to monitor and maintain onsite or individual liquid waste systems, and there are no plans to develop such programs. Pennington and Meade Counties have proposed ordinances to require inspection of existing septic systems. A draft of the ordinances has been provided to the Department of Environment and Natural Resources.

The State does not track the number of permits issued each year, either for new construction or for system repair/replacement.

In South Dakota, a failed system is one that allows wastewater to surface on the ground or enter any waters of the State. Graywater systems are exempt from this requirement in locations where they will not create a public nuisance or enter any waters of the State. Failure to conduct percolation tests for determination of drainfield size, poor installation, and lack of proper maintenance are cited as the most commons reasons for system failure.

South Dakota has a licensing/certification program for onsite wastewater professionals. DENR staff, County Planning and Zoning inspectors, and South Dakota Plumbing Inspectors are licensed to perform site evaluations/inspections.

mounds and other alternatives.
