Liquid Waste Disposal Regulations
20 NMAC 7.3

Onsite regulations for New Mexico were last updated in October 1997.  Currently, the regulations are under revision with an approximate approval date for summer 1999.  The revisions will add design criteria for mounds, evapotranspiration systems, greywater, and sand filters.  Performance based standards and alternative technologies will be addressed.

Currently, all alternative technologies must be designed by an engineer.  Aerobic treatment units (ATUs) are considered a conventional technology.  New Mexico requires National Sanitation Foundation (NSF) or Baylor University certification for aeration systems.  Experimental technologies may be proposed and reviewed for acceptance through an exception or variance.

The state of New Mexico recognizes but does not require management or maintenance districts to monitor and maintain onsite systems.

The Rural Utilities Service (RUS) of the United States Department of Agriculture (USDA) offers funding to assist homeowners with replacement of failing systems or installation of new systems.  Loans and grants are available for rural areas and towns with populations up to 10,000.  Direct 502 loans are available to low income families at 1% and 504 loans of up to $20,000 at 1% for 20 years are also available.  Contact Mr. Steve Anaya, State Director for RUS, at (505) 767-4950, for further information.

Licensing is a requirement for contractors in New Mexico.  There are plans to develop a certification program for all wastewater professionals in New Mexico.

The State of New Mexico does not provide training for wastewater professionals.
